Rachel Badilla, who formerly managed the Kennedy House condo in North Bay Village, Robert Dugger (her step-father) and Rachel Dugger  (her mother ) pled guilty to theft related charges regarding their activities at the condominium. Robert Dugger and Rachel Dugger entered pleas of guilty to Conspiracy to Commit Grand Theft.  Rachel Badilla entered pleas of guilty to Conspiracy to Commit Grand Theft, Grand Theft in the Second Degree and Grand Theft in the Third Degree.  Their crimes related to writing a fraudulent check on the Kennedy House Condo Association account, removal of much of the contents of one of the condo units and a fraudulent short sale of the Duggers’ condo residence.  As a part of the plea agreement, all the victims are to receive restitution.

Robert Dugger and Rachel Dugger received a withhold of adjudication on their charges, serve 5 years of probation and perform 300 hours of community service.   Rachel Badilla was adjudicated guilty on the Second Degree Grand Theft of the condo contents and received a withhold of adjudication on the remaining charges. , Rachel Badilla will also serve 5 years of probation and perform 300 hours of community service.    All three agreed to permanently surrender their Community Association Manager licenses and remain out of the business for the duration of their respective probations.

“Too many condo residents have been victimized by criminal managers,” stated Miami-Dade State Attorney Katherine Fernandez Rundle. “This case should be a message for those who feel they can use condo funds and resources for their own benefit.  Police and prosecutors are looking for you and we will get you.  Future improvements in our Florida statutes will only make these prosecutions easier.”
